1. Agreement & Eligibility

These Terms of Service (“Terms”) are an agreement between you and Bashabeth Games (“Bashabeth,” “we,” “us,” or “our”) governing your use of websites, games, online services, downloadable or browser-based software, multiplayer features, digital content, and related services that we operate and that link to these Terms (collectively, the “Services”). Our Privacy Policy explains how we handle personal information and is incorporated by reference where permitted by law.

You must be legally capable of entering into these Terms. If you are under the age of legal majority where you live, your parent or legal guardian must review and agree to these Terms on your behalf where required by law. Services that are not intended for children under 13 must not be used by children under 13 without any legally required parental involvement.

If you access a Service on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

2. License to Use the Services

Subject to these Terms and any additional terms presented with a particular game or platform, Bashabeth Games grants you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for lawful personal entertainment purposes.

The Services are licensed, not sold. Except where applicable law expressly permits otherwise, you may not copy, reproduce, distribute, publicly perform, publicly display, sell, rent, lease, sublicense, modify, adapt, translate, reverse engineer, decompile, disassemble, derive source code from, circumvent technical protections of, or create derivative works based on the Services or any portion of them without our written permission.

3. Accounts & Security

Some Services may require a Bashabeth Games account, a third-party platform account, or both. You agree to provide accurate information when required, keep account credentials secure, and promptly notify us or the relevant platform of suspected unauthorized access.

You are responsible for activity conducted through your account to the extent permitted by law. You may not sell, rent, transfer, share, or provide access to an account where doing so violates these Terms, a platform’s rules, or applicable law.

4. Rules of Conduct

When using the Services, you must not:

• cheat, exploit bugs, use unauthorized bots, automation, macros, scripts, trainers, injected code, modified clients, or other tools to gain an unfair advantage or disrupt gameplay;
• interfere with servers, networks, matchmaking, security systems, rate limits, authentication, or other technical protections;
• attempt to access another user’s account, private data, or restricted systems without authorization;
• harass, threaten, stalk, defraud, impersonate, or abuse another person, or engage in hateful or unlawful conduct;
• post, transmit, or distribute unlawful, infringing, malicious, deceptive, sexually exploitative, or otherwise prohibited content;
• use the Services to distribute malware, phishing, spam, or malicious links;
• manipulate purchases, rewards, rankings, matchmaking, referral/invite systems, virtual economies, or competitive results through fraud or collusion;
• commercially exploit the Services or virtual content except as expressly authorized by us; or
• encourage or assist another person in violating these Terms.

We may investigate suspected violations and take proportionate action, including removing content, invalidating results or rewards, restricting features, suspending accounts, or terminating access.

5. Online Play & Moderation

Online features may involve matchmaking, rankings, leaderboards, user-generated display names, invitations, competitive results, or interactions with other users. You understand that multiplayer experiences may vary based on network conditions, player behavior, server availability, and game updates.

We may use automated and manual systems to detect cheating, fraud, abuse, exploits, security threats, or violations of game rules. Competitive results, rewards, or virtual items obtained through exploitation, error, or prohibited conduct may be corrected, removed, rolled back, or invalidated.

6. Purchases, Digital Content & Virtual Items

Some Services may offer paid games, downloadable content, digital items, virtual currency, entry fees, subscriptions, upgrades, cosmetic items, or other digital entitlements (“Digital Items”). Prices, taxes, availability, and payment methods are shown at checkout or by the applicable storefront or platform.

Digital Items are licensed for use within the applicable Service and do not give you ownership of underlying intellectual property. Unless required by law or expressly stated otherwise, Digital Items have no cash value, are not legal tender, are not redeemable for money, and may not be sold, transferred, or exchanged outside mechanisms expressly provided by the Service.

We may modify, rebalance, replace, suspend, or discontinue Digital Items or game economies for legitimate game-design, security, legal, technical, or operational reasons, subject to applicable consumer law.

Payments may be processed by third parties such as Stripe or by the storefront/platform where you obtained a Service. You agree to comply with the payment provider’s or storefront’s applicable terms in addition to these Terms.

7. Refunds, Billing Disputes & Chargebacks

Refund eligibility depends on applicable law, the nature of the purchase, and the rules of the storefront or payment processor used for the transaction. Where you purchase through Steam, an app store, a web game portal, or another third-party platform, refund requests may need to be submitted through that platform.

Nothing in these Terms limits any refund, cancellation, withdrawal, warranty, or other consumer right that cannot lawfully be waived. If a separate refund or cancellation policy is presented at checkout, that policy also applies to the purchase.

If you believe a charge is incorrect, contact us or the relevant payment provider before initiating a chargeback where practical. Fraudulent chargebacks, payment abuse, or attempts to retain Digital Items after a refunded or reversed transaction may result in removal of the affected entitlement or account restrictions where permitted by law.

8. User Content & Feedback

If a Service allows you to submit names, messages, images, designs, replays, posts, or other content (“User Content”), you retain ownership of rights you already have in that content. You grant Bashabeth Games a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify for technical purposes, display, communicate, and distribute that User Content only as reasonably necessary to operate, provide, moderate, promote, or improve the Service in which it was submitted, subject to applicable law and privacy rights.

You represent that you have the rights necessary to submit User Content and that it does not violate law or third-party rights.

If you voluntarily provide ideas, suggestions, feature requests, or other feedback about the Services, you permit us to use that feedback without restriction or compensation, provided that this does not transfer ownership of your pre-existing intellectual property.

9. Intellectual Property

The Services, including game code, software, characters, artwork, animations, audio, music, logos, names, designs, interfaces, text, databases, and other content provided by Bashabeth Games, are owned by or licensed to Bashabeth Games and are protected by copyright, trademark, and other intellectual-property laws.

These Terms do not grant you ownership of any Bashabeth Games intellectual property or any third-party content included in a Service. Any rights not expressly granted are reserved.

10. Third-Party Platforms & Services

The Services may be distributed through or integrate with third parties such as game storefronts, hosting providers, payment processors, authentication providers, social platforms, or web game portals. Your use of those services may also be governed by their own terms and policies.

We are not responsible for third-party services that we do not control, although applicable law may provide you rights against us in some circumstances that these Terms do not limit.

11. Updates, Early Access & Availability

Games and online Services evolve. We may provide patches, balance changes, new features, content updates, server changes, maintenance, resets, migrations, or other modifications. Features may be added, changed, or removed to improve gameplay, security, performance, legal compliance, or service viability.

Pre-release, beta, prototype, demo, test, or Early Access features may be incomplete, contain bugs, change substantially, experience resets, or be discontinued. Unless required by law or expressly promised in writing, participation does not guarantee that a feature or game will launch in a particular form or remain available indefinitely.

We do not guarantee uninterrupted or error-free availability. We may suspend access for maintenance, security, technical incidents, legal requirements, or circumstances beyond reasonable control.

12. Suspension & Termination

You may stop using the Services at any time. Where account deletion is available, you may request it through the relevant Service or by contacting us, subject to information we may lawfully retain.

We may suspend or terminate access, restrict features, or remove content if we reasonably believe you violated these Terms, created security or legal risk, engaged in fraud or abuse, or if a Service is discontinued. Where required by law, we will provide any notice, explanation, appeal, refund, or remedy that must be provided.

Sections that by their nature should survive termination—including intellectual property, disclaimers, liability limitations, and dispute provisions—will survive to the extent permitted by law.

13. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” BASHABETH GAMES DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Services will always be available, secure, uninterrupted, error-free, compatible with every device, or free from data loss, exploits, cheating, or other harmful components.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BASHABETH GAMES AND ITS OWNERS, AFFILIATES, LICENSORS, SERVICE PROVIDERS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY ARISING OUT OF OR RELATED TO THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO A PAID SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIRECTLY FOR THE SERVICE GIVING RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) US$100. FOR A FREE SERVICE, OUR AGGREGATE LIABILITY WILL NOT EXCEED US$100.

These limitations do not apply to liability that cannot lawfully be limited or excluded, including where applicable liability for fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, or mandatory consumer rights.

15. Indemnity

To the extent permitted by law, if you use the Services on behalf of a business or for commercial purposes, you agree to defend, indemnify, and hold harmless Bashabeth Games and its representatives from third-party claims, liabilities, damages, and reasonable costs arising from your unlawful use of the Services, your User Content, or your material violation of these Terms.

This section does not require a consumer to indemnify Bashabeth Games where such an obligation is prohibited or unenforceable under applicable law.

16. Governing Law & Disputes

These Terms are governed by the laws applicable to Bashabeth Games in the jurisdiction where it is established, without regard to conflict-of-law principles, except that consumers retain the benefit of mandatory protections provided by the laws of their country, state, province, or other place of residence where those protections cannot be waived by contract.

Before filing a formal claim, we encourage you to contact us at bashabethgames@gmail.com so we can attempt to resolve the issue informally. Nothing in this section prevents either party from seeking relief in a court or forum that has jurisdiction under applicable law, and nothing restricts a consumer’s right to use a government agency, regulator, small-claims process, or other remedy that cannot legally be waived.

These Terms do not require mandatory arbitration and do not include a class-action waiver.

17. Changes to These Terms

We may update these Terms to reflect changes to our Services, business practices, or legal obligations. We will post the updated Terms and revise the effective date. If a change materially affects your rights and applicable law requires advance notice or renewed consent, we will provide it before the change takes effect.

Your continued use of the Services after updated Terms take effect constitutes acceptance only to the extent permitted by applicable law.
